The court takes a number of factors into consideration when determining what, if any, spousal maintenance should be provided, including the length of the marriage, the income of each spouse, the needs of each spouse and the standard of living enjoyed during the marriage.
In Minnesota, there are four general categories of spousal maintenance:
Permanent: Support that is paid until the receiving spouse dies or is remarried.
Temporary: Support that lasts for a set period of time. This might include support designed to help the receiving spouse obtain education and work skills that will make it possible for him or her to be more self-sufficient.
Lump sum: A one-time maintenance payment that typically is accompanied by a waiver of all future support payments.
Non-modifiable: Support that the parties agree will not change in amount or duration, no matter what happens.
